BESPOKE CAKE/ARTWORK PROJECT

1. Order Placement and Confirmation:

  • Orders are confirmed after a full or deposit payment is received. Order details, including design, flavours, size, and delivery/pickup information, will be confirmed in the invoice. It is the client's responsibility to review this confirmation and notify us of any discrepancies within 7 days.

  • Changes to the order after confirmation may be subject to additional charges and may not be possible within 7 days prior to the delivery date.

2. Payment:

  • A non-refundable deposit of 50% is required to secure the order. 

  • Invoice for the deposit should be paid within 7 days or as agreed in the invoice.

  • Late deposit payment may result in your order being cancelled or in delays to your project.

  • For orders under £5,000, please ensure the remaining balance is received prior to delivery. For larger orders (over £5,000), it is due within 7 days post-delivery.

  • Our payment method is a bank transfer, details can be found in the invoice.

  • Failure to pay the remaining balance by the agreed due date may result in late payment (1% per month) and administrative fee added. 

3. Design and Customisation:

  • We will work with you to create a custom design based on your specifications.

  • While we strive to replicate designs as closely as possible, slight variations may occur due to the handmade nature of our products.

  • Providing inspiration photos is helpful, but we do not guarantee exact replicas of other bakers' work due to copyright and artistic differences.

  • We reserve the right to make minor adjustments to the design if necessary to ensure structural integrity or quality.

4. Cancellations and Refunds:

  • The deposit is non-refundable.

  • Cancellations made within 14 days of the delivery date will require payment of the full balance.

  • In the unlikely event that we need to cancel the order, a full refund, including the deposit, will be issued.

5. Delivery and Pickup:

  • Delivery is available for an additional fee within the UK. 

  • Delivery times will be scheduled and confirmed with the client. We are not responsible for delays caused by unforeseen circumstances such as traffic or weather.

  • If the client chooses pickup, they are responsible for transporting the cake safely. We are not liable for any damage that occurs after the cake leaves our premises.

  • For tiered cakes or delicate designs, delivery is highly recommended.

6. Liability:

  • We are not responsible for any damage to the cake/artwork after delivery or pickup.

  • We are not liable for any issues arising from improper storage or handling of the cake/artwork by the client.

  • Our liability is limited to the cost of the cake/artwork.

7. Allergies and Dietary Restrictions:

  • Please inform us of any allergies or dietary restrictions at the time of ordering.

  • While we take precautions to prevent cross-contamination, we cannot guarantee that our products are completely free from allergens.

  • It is the client's responsibility to inform their guests of any potential allergens.

8. Rights to Photography and Publication

We retains the perpetual, worldwide right to photograph, video-record, or otherwise document the commissioned cake, food art, and any related preparatory or in-progress work.

This documentation may be used for, but is not limited to, the following purposes:

  • Portfolio: Display on the the professional website.

  • Promotional Materials: Use in brochures, advertisements, and other marketing efforts.

  • Social Media and Blog: Posting on all social media platforms (e.g., Instagram, X, Facebook, TikTok) including blog or newsletters.

9. Client-Requested Publication Embargo and Delay

If the client requires a delay in publication (an "embargo") due to an event's private nature, confidentiality, or to control the timeline of their own announcements (e.g., waiting for their official photographer's release):

  • The Client must inform in writing of the requested embargo period no later than the final payment due date.

  • This notification must include the specific date on which the embargo is to be lifted (the "Release Date").

  • If the Client does not provide a specific release date by the final payment deadline, we reserves the right to publish the work after the date of the event/delivery.

10. Intellectual Property:

  • All designs created by us remain our intellectual property.

  • We retains all intellectual property and copyright ownership of the final design and the artistic work itself, including all preparatory sketches and concepts.

11. Governing Law:

  • These terms and conditions are governed by the laws of United Kingdom.

12. Acceptance of Terms:

  • By placing an order, the client agrees to these terms and conditions.
